PRINCIPAL OF CRIMINAL LIABILITY

The general basis for imposing liability in criminal law is that the defendant must be proved to have committed a guilty act having had a guilty state of mind.

The physical element is called actus reus.

The accompanied mental state is called the mens rea.

Because it is the fundamental duty of the prosecution to prove both of these elements of the offense to the satisfaction of the judge o jury beyond reasonable doubt and in the absence of such proof the defendant will be acquitted.

आपराधिक कानून में दायित्व लागू करने का सामान्य आधार यह है कि प्रतिवादी को यह साबित किया जाना चाहिए कि उसने एक दोषी कार्य किया है, जिसमें मन की दोषी स्थिति है।

भौतिक तत्व को एक्टस रीस कहा जाता है।

साथ में मानसिक स्थिति को मेन्स री कहा जाता है।

क्योंकि यह अभियोजन का मौलिक कर्तव्य है कि अपराध के इन दोनों तत्वों को न्यायधीश या जूरी की संतुष्टि के लिए उचित संदेह से परे साबित किया जाए और इस तरह के सबूत के अभाव में प्रतिवादी को बरी कर दिया जाएगा।

WHAT IS ACTUS REUS??

Actus reus means physical activity and it is the physical result of human conduct which is sufficient harmful and therefore punishable and according to section 32 of IPC, the ct includes illegal example SUPPOSE "A" IS THE PERSON FIRING A GUN TO KILL "B" WHILE SHOOTING "A" HOLDS THE GUN PLACES HIS FINGER ON THE TRIGGER AND AS A CONSEQUENCE OF WHICH THE BULLET LEAVES THE GUN AND "B" DIED. So in this order to constitute an actus reus, there must be the further consequence of the bullet entering "b" body and thereby causing his death or injury.

WHAT IS MEN'S REA??

First of all the meaning of men's rea is "GUILTY MIND"

It is one of the essential parts of criminal liability. A criminal offense is committed only when an act that is forbidden by law is done 

The term "MENS REA" has been given to the violation which is the motive force behind the criminal act. Ordinarily, a crime is not committed if the mind of the person doing the act is innocent.

For example, "A" IS THE PERSON SLIPPED AS HE WALKED AND FE DOWN AS HE FELL HE LOST BALANCE AND PULLED DOWN "B" WITH HIM "B" HITS HIS HEAD AGAINST THE WALL AND SUSTAINED HEAD INJURIES AND DIED SO IS "A" IS GUILTY OF MURDER??

ANSWER: "A" satisfies one portion of the definition of the murder of actus reus means doing an act which causes murder but still it does not constitute the offense of murder because another essential ingredient "men's rea" to cause death is absent hence "A" is not guilty of murder.

यह आपराधिक दायित्व के आवश्यक भागों में से एक है। एक आपराधिक अपराध तभी किया जाता है जब कानून द्वारा निषिद्ध कार्य किया जाता है

शब्द "मेन्स रिया" उल्लंघन को दिया गया है जो आपराधिक कृत्य के पीछे प्रेरक शक्ति है। सामान्यत: अपराध नहीं किया जाता है यदि कार्य करने वाले व्यक्ति का मन निर्दोष है।
